Jame Roll Form Products biometric privacy $538K class action settlement - Top Class Actions

Jame Roll Form Products agreed to pay over $538,000 to resolve claims that it violated Illinois privacy law by collecting biometric data through time clocks.

The settlement benefits individuals who worked for Jame Roll Form Products LLC in Illinois between Aug. 19, 2016, and May 24, 2022, and whose biometric identifiers were collected through fingerprint scan time clocks without the employee first giving written consent.

Jame Roll Form Products is a manufacturing company that produces custom roll form and metal fabrications. This includes angles, bows, beams, brackets, channels, closures, covers, crossmembers, flanges, guides, hats, panels, plates, posts, protectors, rails, stakes, stiffeners, track and many other shapes.

Plaintiffs in a privacy class action lawsuit claim the company unlawfully collected and stored its employees’ biometric information. This conduct allegedly violated employee rights and put them at risk for harm.

Biometrics include unchangeable identifying factors such as fingerprints, retina scans, facial geometry and more. Unlike other identifying information, biometrics cannot be changed if they are compromised through a data breach or user error. As a result, Illinois passed the Biometric Information Privacy Act ( BIPA) to better protect Illinois residents from privacy breaches.

Jame Roll allegedly violated BIPA by collecting employee fingerprints through timekeeping systems without first getting written consent as required by the law. In addition, the company failed to provide the necessary BIPA disclosures, the plaintiffs contend.

Violations of BIPA can result in damages of up to $5,000 per violation. When multiple people are repeatedly affected by BIPA violations, companies can face thousands or millions in penalties. The BIPA class action lawsuit sought damages for each time Jame Roll collected employee fingerprints without consent.

Jame Roll Form Products hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $538,125 class action lawsuit. A settlement helps avoid the cost and risks of continuing to litigate through a trial.

Under the terms of the settlement, class members can collect a cash payment. 

Payment amounts will vary depending on the number of claimants who participate in the settlement. According to the settlement website, class lawyers estimate each claimant will receive between $275 and $400. Actual payments may be higher or lower.

The deadline for exclusion and objection is Dec. 1, 2022. 

The final approval hearing for the Jame Roll Form Products settlement is scheduled for Jan. 25, 2023. 

In order to receive a payment from the settlement, class members must submit a valid claim form by Dec. 1, 2022.
